App Name: Crew Mingle

Welcome to Crew Mingle, a mobile social network designed to connect individuals working in or associated with the cruise line industry. By downloading, accessing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the App.

1. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

2. Account Registration

To access certain features of the App, you must create an account. You agree to provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

3. User Conduct

By using our App you agree not to:

• Use the App for unlawful purposes or in violation of any local, state, national, or international laws
• Harass, abuse, impersonate, or intimidate other users.
• Post or transmit content that is offensive, defamatory, obscene, or otherwise inappropriate Interfere with or disrupt the operation of the App or any networks connected to it.
• Attempt to gain unauthorized access to any part of the App or user data.

4. Privacy

We respect your privacy. Our Privacy Policy outlines how we collect, use, and protect your personal information. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

5. Intellectual Property

All content, trademarks, logos, and intellectual property in the App (except for content posted by users) are owned by or licensed to Crew Mingle and or our partners. You may not copy, distribute, or modify any part of the App without our prior written permission.

6. Ship Schedule Information

Our app provides cruise ship schedules and related data to help users find and connect with friends in port. We make every effort to keep this information accurate and current. However, cruise itineraries can change at short notice due to operational, weather, or port-related factors, and we cannot guarantee the accuracy or completeness of schedule data.

We encourage users to treat the schedule information as a guide only. You should confirm your own ship’s arrival and departure times through official cruise line communications or onboard announcements.

7. User-Generated Content

You retain ownership of content you post, but by submitting it through the App, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content within the App for the purposes of operation and promotion.

We reserve the right (but not the obligation) to remove content that violates these Terms or applicable laws.

8. Intellectual Property

All App content—code, designs, text, graphics, logos—is our or our licensors’ property. You may not reproduce or distribute any part without express written permission.

9. Availability and Access

We aim to keep the App available, but access may be interrupted for maintenance, updates, or other reasons. We are not liable for any downtime or data loss.

10. Disclaimer and Limitation of Liability

To the extent permitted by law:

• The App is provided "as is" without warranties of any kind, either express or implied
• We do not guarantee the accuracy, reliability, or availability of the App or user-generated content
• We are not liable for any loss or damage arising from your use of the App, including (but not limited to) indirect, incidental, or consequential damages
• Nothing in these Terms excludes your rights under the Australian Consumer Law

11. Deals, Offers & Third-Party Businesses

Our platform may display deals, discounts, or promotional offers provided by third-party businesses.
We act solely as a platform to list and promote these offers. We do not:

• Own, control, or supply the goods or services offered
• Guarantee the accuracy, availability, or quality of any offer
• Guarantee that any offer will result in savings or benefits

All offers are provided by independent businesses, and any transaction, purchase, or interaction is solely between you and the relevant business.

11b. Redemption of Offers

When you redeem an offer (whether in-store or online), you agree that:

• The business is solely responsible for honouring the offer
• You must comply with all terms, conditions, and limits specified in the listing, and any ruther terms the business hold regarding sales.
• We are not responsible for any refusal, dispute, or issue arising from redemption

We do not facilitate or process transactions between you and businesses.

11c. No Endorsement

The presence of a business or offer on our platform does not constitute endorsement, recommendation, or verification by us.

11d. Misuse of Offers

You agree not to:

• Abuse, exploit, or manipulate offers
• Attempt to redeem offers beyond stated limits
• Use multiple accounts or other methods to circumvent restrictions

We reserve the right to suspend or terminate your account and/or restrict access to offers where misuse is suspected.

11e. Limitation of Liability – Offers

To the maximum extent permitted by law, we are not liable for:

• Businesses failing to honour offers
• Incorrect or misleading listings
• Unavailability of goods or services
• Any loss, damage, or dissatisfaction arising from your interaction with a business

12. Termination

You may stop using the App at any time. We may suspend or terminate your account or access to the App if you breach these Terms, misuse the App, or if we discontinue the service.
You may delete your account at any time by contacting us at admin@crewmingle.com or from within the App itself. Deletion of your account will also trigger removal of your personal data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on our website or within the App. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
